Terms of Service
Eligibility
- The Service is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use the Service.
- The Service is due to regulatory restrictions not available to any person who is a resident, organised, or located in any country or territory subject to current OFAC or UK, or EU sanctions, including but not limited to Cuba, Crimea region of Ukraine, Democratic People’s Republic of Korea, Iran, Syria, or any person found on the or EU specially designated nationals, blocked persons list, any other consolidated prohibited persons list as determined by any applicable governmental authority.
- $USD reserves the right to remove, block or blacklist any user infringing its eligibility requirements without further notice.
Ownership
- You agree to purchase $USD subject to these terms and conditions. You will own $USD and have rights to use, sell, trade $USD.
- Content included in $USD, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of $USD, our affiliates or other relevant third parties.
- You may not reproduce, copy, distribute, store or in any other fashion re-use material from $USD unless otherwise indicated or unless given express written permission to do so by $USD.
- $USD Contents are provided on the Services “AS IS” for your information and personal use only. Except as expressly provided in these Terms, no part of $USD and no Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
General Terms
- You are responsible for compliance with legal requirements and the assertion of claims arising from $USD. In particular, $USD does not guarantee the accuracy and completeness of the statements and declarations made in relation to $USD, and $USD offered.
- When you purchase $USD, you agree that you are purchasing only $USD and the right to use the associated Contents in accordance with these terms in exchange for the relevant payment.
- Users are required to comply with applicable laws when using $USD. It is each user’s own responsibility to ensure that their offers are lawful and do not infringe the rights of third parties.
Fees, Pricing and Taxes
- If you purchase $USD, any financial transactions that you engage in will be conducted solely through the Solana network.
- You acknowledge that we have no insight into or control over the payment systems used or the transactions made and due to the nature of crypto transactions we have no ability to reverse any transactions.
- We cannot be liable to you or to any third party for any claims or damages that may arise as a result of any transactions that you conduct via the Solana network.
- The use of Solana requires the payment of a transaction fee for every transaction that occurs on the Solana network (“Gas Fee”) and you are required to pay applicable Gas Fee`s for each transaction you carry out.
- Buying, selling $USD may have tax consequences for you and you must take your own tax advice on any consequences of buying, selling $USD.
- We do not facilitate direct payment or withholding of any taxes through the Services and reporting and payment of relevant taxes are always your individual responsibility.
AML and KYC
- In order to comply with laws, rules and regulations applicable to $USD, including those relating to the funding of terrorist activities and money laundering, $USD may be required to obtain, verify and record certain information relating to individuals and entities which maintain a business relationship with $USD.
$USD and Risk Disclosure
- You understand that
- there are serious risks connected with buying $USD, such as heavy fluctuations of virtual or actual currency values, which in turn may lead to total loss of currency over short or long periods.
- $USD is not meant as investments or investment vehicles nor are they Securities of any kind.
- We make absolutely no guarantees, representations, or warranties that $USD will be worth anything more than what you and the market deem the crypto to be worth, which could be less than the price you paid.
- $USD has no inherent monetary value and are not intended to be used for payment or investment purposes.
- You acknowledge and understand that
- $USD has no warranty whatsoever, expressed, or implied, to the extent permitted by applicable Law and accordingly that $USD is purchased on an "as is" basis.

- 8.3. The website is for domestic and private use. If you use the website for any commercial, business, or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
- 9. Even if we delay in enforcing this contract, we can still enforce it later
- If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

- 12. Sub-contracting and Assignment
- $USD reserves the right to sub-contract, transfer, assign, or novate all or any of our rights and obligations under $USD terms and conditions provided that your rights under $USD terms and conditions are not affected. You may not sub-contract, assign or otherwise transfer any of your rights or obligations under these terms and conditions without our consent in writing.
- 13. Events Beyond Reasonable Control
- $USD will not be held responsible for any delay or failure to perform or comply with our obligations under these terms and conditions when the delay or failure arises from any cause which is beyond $USD reasonable control.
- 14. Severance
- Each provision of these Terms shall be construed separately and independently of each other. If any provision is deemed invalid, void, or otherwise unenforceable, that provision shall be deemed severable from and shall not affect the enforceability of any of the other provisions of these Terms.
